James Kovalcin (Kovalcin) appeals from the August 23, 2000 order of the Court of Common Pleas of Luzerne County that dismissed his appeal of a one-year suspension of his commercial driving privileges by the Department of Transportation, Bureau of Driver Licensing (Department) pursuant to Section 1611(a)(3) of the Uniform Commercial Drivers License Act (UCDLA), as amended, 75 Pa. C.S. §1611(a)(3), for his conviction in West Virginia on May 26, 1999 of leaving the scene of an accident. Kovalcin contends that the trial court erred in dismissing his appeal because the Department did not present sufficient evidence of a conviction, which would require the suspension of his license.
